Class action lawsuits are all different, and each will be litigated and resolved in a different manner. While some may ultimately find their resolutions at the end of a lengthy court case, just as many – if not more – are settled between the class and the defendant. From both perspectives, a settlement should be one that resolves the issues at hand to everyone’s mutual satisfaction. To this end, there are red flags that each party should be mindful of when reaching a class action settlement.

Ultimately, the defendant’s goal in reaching a settlement in a class action is to bring closure to the issue at hand and to incur the least possible financial costs.
